System Construction and Rule Advancement of Enterprises Protecting Children's Rights

Abstract: The protection of children's rights in the dimension of enterprise law and enterprise governance is in line with the purpose of enterprise social responsibility rules and enterprise justice, and conforms to the inertia of care for vulnerable groups and the development trend of care practice. It's also the function of enterprise and enterprise law as tools to solve social probolems. At present, the protection of children's rights by enterprises is a dual structure from the abstract constraints of domestic enterprise law rules to the specific guidance of international enterprise codes of conduct. There is a lack of special and direct regulation. The focus is on post-event response. Advanced handling and protection are ignored. This does not match the critical role of business in protecting children's rights, and underestimates the important impact of children's rights on enterprise governance. To this end, under the premise of abiding by the principle of proportionality and enterprise autonomy, adhering to the maximization of children's rights and public-private cooperation, respecting and promising to protect children's rights at the same time, and building five pairs of relationships between normalization and abnormality, it is necessary to reshape the implementation mechanism of children's rights protection in enterprise law, and realize rule advancement in the three dimensions of subject, behavior and responsibility.
