In the era of digital capitalism， the reflection on the new alienation generated in the application of digital technology and the technical criticism of digital capitalism have been launched one after another， and the two are accessible. On the one hand， Marxism discusses technology in the sense of “the relationship between workers and the products of their own labor”， and holds that technology alienation is the manifestation of the misplacement of human technology relationship. On the other hand， Marxism attributes technological alienation to the totality of a certain society， and understands that technological alienation is the accessory of capital relationship and the source of legitimacy of its existence. Today's “digital alienation” is the further continuation of “machine alienation” in the digital age. This logical relevance shows the persistence of Marxist technical criticism. Marxist technical criticism takes “social political” criticism as the background， and always emphasizes the use of realistic material forces to mask capitalism， pointing out the real way for us to frame the reasonable threshold of technology application.

In order to verify the “up close and personal” hypothesis of the trolley problem in the Chinese context， we conduct a repetitive study of Greene's experiment by using the moral dilemma test to explore the effects of factors of spatial distance and personalness on moral judgment. The results show that physical contact， personal force and spatial proximity all have significant experimental effects on moral acceptability scores. In the comparison of the frequency of moral choice， the deontological and utilitarian choices in each group are significantly different， and the utilitarian choices in the four groups also show significant differences. On the whole， with the weakening of personal effect and the extension of spatial distance， moral acceptance evaluation and moral choice tend to be utilitarian. Therefore， the “up close and personal” hypothesis is confirmed in the Chinese cultural context， but there are also cross-cultural inconsistencies.

Will the OFDI Increase the Leverage Risk Level of Enterprises? Typical Facts and Empirical Tests

The complex and changeable external environment makes outward foreign direct investment(OFDI) of enterprises showing the typical characteristics of high leverage risk. Selecting two indicators of enterprise financial leverage risk and operating leverage risk to assess the level of enterprise leverage risk， use OFDI data of A-share listed enterprises， and test the conduction path of OFDI affecting Chinese enterprise leverage risk with the PSM-DID model. The study finds that OFDI increases the risk of enterprise financial leverage and reduces the risk of enterprise operating leverage. Financial leverage risk has been increased by increasing financing constraints， but the influence of R&D investment is not obvious. Operating leverage risk has been reduced by increasing total factor productivity and diversification. Further research also finds that OFDI of business services significantly affect the enterprise leverage risk and the enterprise leverage risk of greenfield investment is relatively high.

Based on the classical theory of planned behavior with consumers in China， Japan， and South Korea as the research objects， this study explores the effect of green product experience on green purchasing intention through structural equation model， aiming to investigate the internal mechanism of the formation of consumers' green purchase intention and the heterogeneity in different countries. The results show that consumers' green product experience in the three countries positively influences their green purchasing intentions. Green product experience also has an indirect influence on consumer green purchasing intention through attitude， subjective norm and perceived behavioral control. Compared with subjective norm and perceived behavioral control， the influence of green product experience on attitude is more significant. Compared with attitude and perceived behavior control， the influence of subjective norm on consumer green purchasing intention is the most significant.

Based on the concept of system dynamics， this paper constructs a platform enterprise innovation ability system dynamics model. This model includes three subsystems: user value creation subsystem， cooperative co-creation subsystem and regional innovation subsystem. Based on system dynamics， this paper studies the influence of users， partners and regional innovation on the innovation ability promotion of platform enterprises. The results show that under different levels of incentives， the impact of user value creation on the innovation ability of platform enterprises is different， and higher level investment of incentives has a positive role in promoting innovation ability. With different number of partners， collaborative co-creation of partners has different effects on the improvement of innovation abilities of platform enterprises， and more partners' participation in value co-creation has a positive promoting effect. The investment of innovation resources in different regions has different effects on the improvement of the innovation ability of platform enterprises. Low-level or ultra-high level investment of innovation resources has a positive promoting effect.

In order to explore the core problem of “how to stick to the original intention of serving the people under pressure”， the grounded theory is used to conduct an in-depth discussion on the public service motivation of 24 urban community workers. It is found that community workers' public service motivation consists of five dimensions: self-dedication， commitment to public interest， sympathy， gratitude and self-actualization. Their motivation is influenced by individual factors (organizational identity， craftsman spirit， sense of occupational gain， psychological capital) and organizational factors (transformational leadership style， community administration). All the above factors can have a direct impact on the public service motivation of community workers， while organizational factors may also have an indirect impact on the public service motivation through individual factors. Based on this， a model of formation mechanism of urban community workers' public service motivation is constructed， which not only absorbs previous research results， but also includes newly discovered categories and relations.

Using the policy diffusion theory and introducing multiple logics， we employ event history analysis to analyze panel data from 31 provinces in China from 2010 to 2019， and examine the organizational behavior logic of the dominant role of government purchases of home-based care services in the diffusion process. It is found that the demand driven by the degree of aging is not obvious in the diffusion process of the government's purchase of home-based care services policy， but is driven by the dual logic of efficiency and legitimacy. Among them， the impacts of regional fiscal capacity， economic conditions， horizontal intergovernmental competition and early release of central administrative signals is the most significant. In addition， the relationship between the age of “the head of local government” and policy adoption is shown as a U-shape.

Explanations of the difficulty in implementing policies at the grassroots level have focused more on single-stage factors or their superimposed effects， and thus weakened cross-stage integration analysis. Based on field observations and in-depth interview analysis， it can be found that behind the difficulty in implementing policies at the grassroots level， there is a policy gap factor between the “down-embedding” of the upper-level policy objectives to the grassroots level， which is specifically represented as a strip-piece gap between rigid-down and flexible embedding， far-near gap between overall-down and step-by-step embedding， and point-surface gap between the inclusive-down and differentiated embedding. They intensify the balancing， transitional and partial problems in the implementation of grassroots policies. The policy gap is the result of the “high-level formulation and low-level implementation” policy structure and the “decision-making reduction and implementation consultation” policy process. It is the space-time gap in the connection between the logic of the bureaucratic system from top to bottom and the logic of social context from the inside out. Grassroots policy implementation in the context of policy gaps should pay attention to two misunderstandings of perfectionism and systemic inefficiency， and adopt active response strategies of maximum reduction and gradual adjustment.

In the case of Yang Fengshen's illegal manufacture of explosives， the handling of the exemption from punishment is an error in the application of the law and the handling of the conviction is also improper. China's existing substantive law system of exoneration and procedural immunity mechanism focuses on the balance of policy and neglects the consideration of individual justice between crime and non-crime. The remedy of special procedures becomes the last resort when this shortcoming cannot be resolved by exhausting substantive law resources and existing procedural exoneration mechanisms. It is necessary to construct a special procedure exoneration mechanism in China by extending the mechanism of procedural exoneration， and correct the judicial conservatism by the procedural discretion controlled by the high-level judiciary. The inherent consistency of the principle of a legally prescribed punishment for a specified crime in the protection of human rights makes it constructive. The construction of the exoneration mechanism for special procedures makes up for the ineffective operation of the exoneration mechanism for general procedures. It forms the dynamic balance between the judicial restriction and the legislative expansion， realizes the unification of the class case balance and the individual case balance， provides the smoother channel of the crime， and promotes the new growth of the law.

The order law interest is an objective existence which cannot be ignored in the crime of contract fraud and has the independent function of distinguishing ordinary crime of fraud. Although the distinction between economic contract and personal exclusive contract， as well as the distinction between business subject and individual natural person， can provide a certain standard for the division of two crimes and the qualitative determination of “double-fraud” cases， it is only the induction of the type of extension of order law interest at the experience level， and cannot exclude counterproof existence. Starting from the market essence of “letting market subjects freely participate in market trading activities”， the core connotation of order law interest should be “the freedom of independent participation of market subjects in market trading activities”. In the specific application of the crime of contract fraud， “the victim's freedom of property disposal and the freedom of independent participation in market trading activities” should be specifically integrated into the judgment of constitutive elements， so as to give play to the limited function of the order law interest and avoid the practice of “contract requirements only becoming a mere formality”.

The protection of children's rights in the dimension of enterprise law and enterprise governance is in line with the purpose of enterprise social responsibility rules and enterprise justice， and conforms to the inertia of care for vulnerable groups and the development trend of care practice. It's also the function of enterprise and enterprise law as tools to solve social probolems. At present， the protection of children's rights by enterprises is a dual structure from the abstract constraints of domestic enterprise law rules to the specific guidance of international enterprise codes of conduct. There is a lack of special and direct regulation. The focus is on post-event response. Advanced handling and protection are ignored. This does not match the critical role of business in protecting children's rights， and underestimates the important impact of children's rights on enterprise governance. To this end， under the premise of abiding by the principle of proportionality and enterprise autonomy， adhering to the maximization of children's rights and public-private cooperation， respecting and promising to protect children's rights at the same time， and building five pairs of relationships between normalization and abnormality， it is necessary to reshape the implementation mechanism of children's rights protection in enterprise law， and realize rule advancement in the three dimensions of subject， behavior and responsibility.

Accurate application of treaties is an important embodiment of China's judicial level. Chinese courts should apply CISG according to its own rules， relevant provisions of domestic laws and normative documents. The abandonment of Article 142 of the General Principles of Civil Law by the Civil Code leads to the absence of applicable rules of civil and commercial treaties in China. However， based on the obligations of contracting parties and the consistent practices of China's judicial system， CISG will still be applied by Chinese courts after the implementation of the Civil Code. CISG has three ways of application， i.e. direct application， indirect application and agreed application. In terms of the application of CISG， there are such problems in China as the absence of legislation， the misunderstanding of the rules by the court， the improper exclusion and the inaccurate application of the rules， etc. To solve these problems， in addition to changing the laws， the Supreme Court can also standardize and unify the application of CISG by issuing judicial interpretations， guiding documents and guiding cases. At the same time， the court should also unify the analytical paradigm of CISG and improve the ability to use CISG for reasoning.

Since the 18th national congress of the Communist Party of China， Xi Jinping has repeatedly interpreted the important value of the spirit of struggle. The generative logic of the spirit of struggle in the new era is rooted in the Marxist view of struggle. Based on the meta-analysis of 64 mobile inquiry-based learning experiments and quasi experiments in domestic and foreign important journals from 2008 to 2020， this paper explores the overall effect and moderating effect of mobile inquiry-based learning. The results show that mobile inquiry-based learning has a significant positive impact on the learning effect. Mobile inquiry-based learning has a positive role in promoting the learning process of students， and greatly improves the learning effect of students. Specifically， at the level of low-level cognition and high-level cognition， mobile inquiry-based learning has moderate positive impacts on the learning effect， and small promoting effects on the behavioral level. On the emotional level， mobile inquiry-based learning only has a small positive impact on learning interest and technology acceptance. Meanwhile， the learning effect of mobile inquiry-based learning is affected by the adjustment variables such as learning period， discipline， implementation environment， teaching method， interaction type， and hardware type.
