    Paradigm Transformation of Realizing Contemporary Technological Ethics

    The paradigm of realizing technological ethics is an important issue in the field of contemporary philosophy of technology. According to the basic categories of technological ethics, the realization of technological ethics means the implementation of the ought-to-be relationship between human and technology in practice, as well as the realization of the ethical potential of agents in action. Thus, the paradigm transformation of realizing technological ethics can be anchored as follows: the ethical purpose has shifted from defending the boundary between human beings and technologies to pursuing the authentic coexistence of human beings and technologies, the ethical agents have changed from humans with absolute autonomy to human-technology hybrids, and the mechanism has turned from the external ethical stipulation to the inter-embedded accomplishment of ethics and technologies. The value orientation behind the paradigm transformation includes the recovery of practical interest of technological ethics, post-humanist perspectives and ethical norms based on responsibility.

The key feature of privacy economy is that personal privacy becomes the raw materials of data in the production process of big data. The essence of capitalist privacy economy in the era of big data is the exploitation of personal privacy by data and media enterprises. The expansion of privacy economy has given birth to the emergence of data factory society, in which the ultimate goal of ubiquitous surveillance is to realize the profits of data capitalists.

    On the Difference Between Artificial Intelligence and Human Intelligence

    Artificial intelligence has opened a new way of technological evolution after biological evolution and cultural evolution, and promoted the integration of human beings and technology. Artificial intelligence can play auxiliary and enhanced functions, but it cannot completely replace the embodied and socialized human intelligence. The one-dimensional definition of “cognition” simplifies intelligence into specific rational cognition, and the multi-dimensional definition of “mind” introduces “subjective” experience, consciousness, emotion and other factors to examine intelligence. Based on the philosophy of mind, the essential differences between human intelligence and artificial intelligence are analyzed from the perspective of society: human intelligence has creativity, and artificial intelligence shows some creativity in the results but it does not necessarily do so in the process; human intelligence has emotionality, which is the integration of mind and body, sensibility and rationality, as well as subjectivity and objectivity; human intelligence has intentionality, which can be related to external objects or things beyond its own activities.

    The Influence of Stock Liquidity on Tail Risk of Stock Market: An Empirical Research Based on POT Model

    In view of the irrationality of the normal hypothesis of the value-at-risk model, the POT model based on the generalized pareto distribution is used to measure the tail risk of China's stock market, and the influence of stock liquidity on the tail risk of China's stock market is explored by grouping the sample data according to liquidity. In the research, the slope change point theory in statistical theory is introduced into the traditional threshold selection method, which effectively avoids the subjectivity problem when determining the optimal threshold. The test results show that for the measurement of tail risk of the stock market, the VaR value at the 95% confidence level is more reliable than the estimated result of the VaR value at the 90% confidence level, and the estimated value shows that tail risk and liquidity change in the opposite direction, that is, the smaller the stock liquidity is, the greater the market tail risk.

    On the Impact of Mobile Technology on Work-family Conflicts During Non-working Hours

    From the perspective of role integration, this study focuses on the work-family conflicts of employees during non-working hours caused by mobile technology use, and explores the influence mechanism of mobile technology use on work-family conflicts. With the help of resource conservation theory, the study introduces two moderating variables of work control and work separation, and further explores the effect of mobile technology use during non-working hours on employees' work-family conflicts under different contexts. The results show that the time and frequency of mobile technology use have a significant positive impact on work-family conflicts during non-working hours. Role integration plays a mediating role, and resource acquisition represented by work control and resource protection represented by work separation play a moderating role.

    Will Free Gifts Please Customers: Views Under Benefit Congruency Framework

    In order to grasp the essence of free gifts promotion based on the theory of benefit congruency framework, this paper constructs a model that affects customer delight and examines the moderating effect of perceived uncertainty and customer type. It is found in the study that compared with not giving free gifts, free gifts promotion can significantly enhance customer delight. Hedonic gifts are more effective than utilitarian gifts in driving customer delight when customers purchase hedonic products. Differently, utilitarian gifts and hedonic gifts have no significant difference in driving delight when customers purchase utilitarian products. Additionally, customer type and perceived uncertainty significantly moderate the relationship between hedonic product-gift promotion benefits and customer delight.

    Under the background of rural culture promotion strategy, new able villagers have provided new ideas for solving the plight of the serious shortage of rural public cultural service supply. Based on “double-layer identity and action model”, Shiyangtang Town, Hunan Province is used as the object to study the role of new able villagers in the provision of public cultural services. It is found in the research that new able villagers play the role of a communicator between the government, the society, the market and the villagers, and that they play a role in feeding back villagers' public cultural needs, assisting the government to perform cultural service functions, integrating social welfare cultural resources, and promoting the participation of market forces. It also expounds the mechanism of new able villagers' participation from three dimensions, i.e. local identity is the foundation, organizational identity is the guarantee, and status identity is the core. The government should give full play to the role of new able villagers to effectively improve the level of rural public cultural services.

    As the internal practice mechanism of political order at the grass-roots level, village governance by the rich is a common phenomenon of grass-roots governance. Based on the social structure of the clan-based village, the Pearl River Delta region has formed a type of feedback-oriented village governed by the rich. Village governance by the rich arises from the structural demand that the order of the village is difficult to maintain, and shows strong feedback characteristics. The driving force of village governance by the rich lies in gaining the recognition from the masses and thus realizing the meaning and value of life by “giving back” to the village. The strong social connection of the village and the abundant collective economy jointly maintain the public nature of village governance by the rich and avoid the alienation of village governance. Village governance by the rich has remolded the grass-roots political ecology through the integration of the elite, the integration of the organizational structure and the activation of Party members, and shaped the stability of grass-roots order and village political integration. In the Pearl River Delta region, village governance by the rich has important enlightening significance for understanding the formation of grass-roots order.

    PPP(public-private partnership) is a cooperative mode in which the government and social capital jointly provide public goods and services, and is an important tool to promote modern economic construction. From the perspective of responsibility realization, there are many responsibility issues in PPP projects, such as unclear division of responsibilities, inadequate implementation, lax accountability and so on. Based on the actual situation of the development of PPP projects in China, this study takes the successful experience and failure lessons of municipal waste incineration projects as examples, and analyzes the responsibilities of both the government and social capital in PPP municipal waste incineration projects in the five stages of project identification, preparation, procurement, implementation and handover through investigation and interviews. It aims to awaken the sense of responsibility, construct and improve the responsibility mechanism, and clarify how the pluralistic subjects clearly define responsibilities, faithfully fulfill their responsibilities and strictly pursue accountability, so as to provide suggestions and reference directions for the responsibility issues in the practice of PPP projects, promote and ensure the successful implementation of PPP projects.

    The rapid development of the Internet has provided a new platform and channel for the irrational expression. As an abnormal form of conflict, the irrational expression on the Internet is generally deemed to cause social disorders. However, the driving forces, which turn oral speeches into irrational behaviors, may be weakened by the following factors: the resolving force from the catharsis, the centrifugal force of individuals among groups and the resistance from a complex external environment, making it difficult to disrupt social orders. The interaction of these three forces forms a weak-force field, which prevents the online irrational expression from being turned into disorderly behaviors, but is at unpredictable risks. The condition exhibits a “quasi-static” state between order and disorder. To construct an ideal and orderly society, the adjustment of weak-force field should cooperate with the other concepts of governance and play valid roles jointly.

    From “Intention” to “Fault”: Reshaping the Regulation of Trademark Indirect Infringement Taking the Judicial Application of Item 6, Article 57 of the Trademark Law as the Research Object

    Item 6, Article 57 of the Trademark Law takes trademark indirect infringement as the object of regulation, and limits the object of regulation to the contributory infringement under the subjective intentional control of the actor. This kind of regulation limits the behavior patterns that can be adjusted by the trademark indirect infringement system, and results in insufficient system supply in the face of various forms of indirect infringement. The contradiction between the diversified forms of infringement and the narrow adjustment scope of legal regulations is more prominent. In judicial practice, there are some dilemmas, such as admitting the duty of care but denying the liability of negligent infringement, confusing the subjective “knowing” and “should know” of the actor, and replacing the legal “intentional” elements with the actor's “fault”. We should confirm the multiple fault forms of trademark indirect infringement in legislation, expand the scope of adjustment of the regulation provisions of trademark indirect infringement from “intentional” infringement to “fault” infringement, distinguish “knowing” and “should know”, and introduce “presumptive knowing” rules to realize the diversification of the liability for infringement damages.

    Study on the Settlement and Compliance Mode for Governing Corporate Lawbreaking in China

    There are three types of law enforcement mode for governing corporate lawbreakers in modern countries: the strict sensation mode, the discretionary non-punishment mode, and the settlement and compliance mode. At present, China employs a co-governance method in adopting the strict sensation mode together with the discretionary non-punishment mode. The duality of law enforcement results in great social consequences, poor long-term effects, and difficulties in meeting the needs of international economic and trade development. The judicial concept underlying law enforcement in China is undergoing a transition from retributive justice to compatible restorative justice. In order to govern corporation misconducts effectively in China, the settlement and compliance mode should be introduced at the system level, including setting up the deferred prosecution procedures for corporate crimes, fully implementing the administrative settlement mechanism for corporate wrongdoers, and clarifying the core position of compliance in settlements.

    Research on the Path of Reflexive Law of Biosafety Regulation

    Biosafety is an important part of national security. To cope with the biosafety crisis, all countries have successively formulated a series of regulatory laws, but the actual results have not been significant. One important reason is that it relies too much on the “command-control” regulatory path, and ignores the complexity of the highly differentiated society and the unique operating laws of other social subsystems. In practice, the biosafety regulatory path has plunged into such difficulties as insufficient constraints, decentralized and flooded legislation, and loose supervision, etc. In this regard, the theory of reflexive law in sociology of law recognizes the limitation of legal cognition capacity, emphasizes the self-regulation of various social subsystems, and provides a new way to break the bottleneck of China's biosafety regulation. Based on paradigm innovation under the framework of reflexive law combined with its organizational, procedural and negotiation regulatory strategies, a semi-autonomous social system for biosafety is formed to overcome the disadvantages of the traditional regulatory model.

    The world today is undergoing a big change which has not been seen in a century. Various risks and challenges are becoming more and more prominent. The key to building a community with a shared future for mankind lies in focusing on the overall well-being of mankind, regaining the forgotten “human consciousness” and developing a concept of co-existence. In the middle of the 19th century, Marx always maintained his ideological view and value concern for a community of a shared future for mankind when he answered the question of “who is human being” and “where will human being go”, which is prominently reflected in his “species philosophy”. From the dimension of the value of human freedom, Marx lays down the genus existence and genus nature of mankind. From the view of the objective law of social development, he explores the alienation and sublation of man and the process of differentiation and integration of the society, thus providing a profound thought foundation for protecting the bottom line of human common value today and rebuilding the community order of human society. From this point of view, a community of a shared future for mankind is on the extension line of Marx's “species philosophy”.

    From Hegel, Feuerbach to Marx, successive philosophical revolutions have led to the focus of disputes over the concept of reality. Hegel promoted reality as the content of philosophical research. Reality in Hegelian philosophy is something inevitable in the process of its development, and it is the objectified existence of spiritual entity. After Feuerbach's philosophical revolution of Hegel, the fundamental provisions of reality have changed from rationality to perceptuality, from the objective existence of absolute spirit to the existence of directness. In Marx's revolution of Feuerbach's philosophy, Hegelian philosophy and empiricism, reality has become the objectified existence of labor, and reality is historical. The process of philosophical revolution is also the history of the changes of the meaning of the concept of reality.

    By taking “sound” as a pointcut, White Noise, one of the remarkable works of contemporary American writer Don DeLillo, explores the relationship among soundscape, consumption and ethics. Through auditory imagery and sound description in this novel, DeLillo points out that the prosperity of commodity economy, progress of science and technology and over-development of media culture in the post-modern society have brought about the destruction of the living environment and the imbalance of spiritual ecology, which inevitably lead to people's deep fear of death. Meanwhile, DeLillo attempts to remind modern people that a harmonious multi-layered relationship between individuals, human and nature, human and society, and society and nature might be achieved by reshaping an awareness of ecological holism and a healthy social-ecological environment, in which a sustainable development can be fundamentally actualized.
