知识产权领域腐败问题实证分析及防治对策

摘要： 立足知识产权领域腐败问题现实表现，分析其“传统腐败”“隐形腐败”“灰色腐败”类型特征，研究其在损害公权力廉洁性、悖离激励创新导向、扰乱市场竞争秩序、侵害主体合法权益、影响我国国际形象等方面的社会危害。研究发现:知识产权领域腐败现象表现出在一定时期内长期存在、形式多样、螺旋式反复发展、具有一定起伏性等趋势特征。知识产权领域腐败诱因包括知识产权与公权力之间存在天然纽带关系、审批机制和保障制度制约规范不够、腐败成本收益比例严重失衡等。从完善“审批”保障制度、“权利”保障制度、“监督”保障制度、“惩治”保障制度方面入手，可有效防治知识产权领域腐败问题。

Abstract: Based on the practical manifestation of corruption in the field of intellectual property rights， the characteristics of the types of “traditional corruption”， “hidden corruption” and “grey corruption” are analyzed and the social harms are studied in terms of impairing the integrity of public power， deviating from the orientation of encouraging innovation， disturbing the order of market competition， impairing the legal rights and interests of the subjects， and affecting the international image of China， and etc. The study found that the phenomenon of intellectual property corruption will be long-term existence in a certain period， and is characterized by diverse forms， spiral repeated development， and a certain fluctuation. The reasons of such corruption are explored including the natural relationship between intellectual property rights and public power， the inadequacy of examination and approval mechanisms and security systems， and the serious imbalance of the cost-benefit ratio of corruption. Accordingly， corruption in the field of intellectual property rights should be handled by perfecting the guarantee system of “examination and approval”， “rights”， “supervision” and “punishment”.
